By creating an account or using TherapyFoundry, you agree to these terms. Please read them. If you are using TherapyFoundry on behalf of an organization, you represent that you have authority to bind that organization to these terms.
These Terms of Service ("Terms") are a legal agreement between you and Peachy Media Group LLC ("we," "us," "our"), the company that operates TherapyFoundry. They govern your use of the TherapyFoundry platform, including all products: the Learner Platform, Back Office, Exam Prep, and Intern Orientation tools (collectively, the "Service").
You must be at least 18 years old to use the Service. By using TherapyFoundry, you represent that you are a licensed or pre-licensed mental health professional, or an authorized administrator at a mental health organization. We reserve the right to verify credentials and terminate accounts that do not meet these requirements.
You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at info@therapyfoundry.com if you suspect unauthorized access. You may not share account credentials or use another person's account.
If your account is provisioned by a tenant organization (your employer or agency), that organization controls your access and may deactivate your account. We are not responsible for a tenant's decisions about your account.
You agree not to:
TherapyFoundry issues CE certificates for courses that have been approved by the California Board of Behavioral Sciences (BBS) or other relevant licensing bodies. It is your responsibility to verify that the courses you complete satisfy your specific license renewal requirements. We do not guarantee that any certificate will be accepted by any licensing board, and we are not responsible for licensing decisions made by regulatory authorities.
You agree not to alter, forge, or misrepresent any certificate issued by the Service.
Payments are processed by Stripe. By purchasing a course or subscription, you authorize us to charge your payment method for the stated amount. All prices are in USD.

All course content, platform design, code, and materials available through the Service are owned by Peachy Media Group LLC or its content licensors, and are protected by copyright and other intellectual property laws. Your purchase grants you a personal, non-transferable license to access and use the content for your own professional development. You may not reproduce, distribute, or create derivative works from any platform content without our written permission.
If you submit feedback, suggestions, or other content to us, you grant us a perpetual, royalty-free license to use that content to improve the Service.
Organizations that license TherapyFoundry infrastructure ("tenants") agree to a separate agreement with Peachy Media Group LLC. Tenants are responsible for their own content, their users' compliance with these Terms, and maintaining appropriate HIPAA safeguards if their use involves protected health information. Peachy Media Group LLC is not responsible for the content, practices, or decisions of tenant organizations.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.
To the maximum extent permitted by law, Peachy Media Group LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Peachy Media Group LLC, its officers, employees, and agents from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
We may suspend or terminate your account at any time if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. You may close your account at any time by contacting info@therapyfoundry.com. Upon termination, your right to access the Service ends immediately. Sections 5, 7, 9, 10, and 11 survive termination.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. When we make material changes, we will update the effective date and notify active users by email at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
